Chapter Five

On the suspension of the rights and freedoms

Article 55

1. The rights recognized in Articles 17, 18 (paragraphs 2 and 3), 19, 20 (paragraphs 1 a, 1 g, and 5), 21, 28 (paragraph 2) and Article 37 (paragraph 2) may be suspended in the event of decision to impose a state of emergency or osadnogo provisions in accordance with the conditions provided for by the Constitution. In relation to the state of emergency is excluded from the above article 17 (paragraph 3).

2. An organic law may determine the form and cases where an individual basis and with the necessary judicial intervention and the appropriate parliamentary control, prava recognized in Article 17 (paragraph 2) and Article 18 (paragraphs 2 and 3) can be held against certain persons in connection with the investigation of the relevant activities of armed gangs or terrorist elements. Unjustified or excessive use of authority recognized in the organic zakone entails criminal liability for violation of the laws of the recognized rights and freedoms.
