1. The rights and freedoms recognized in the second chapter of this Section shall apply to all public authorities. Only the law, which in any case must respect the basic content of the above rights and freedoms may regulate their exercise, the procedure for their ohrany established in Article 161.1a.
2. Any citizen may claim the protection of the rights and freedoms set forth in Article 14 and in the first part of the second chapter before any court, and the case should be considered on the basis of the principles of preference, with the conduct of the investigation and, if necessary, by means of the application for appeal to the Constitutional Court . This procedure applies to otkaze from military service based on the beliefs of non-compliance, in accordance with Article 30.
3. Recognition, respect and protection of the principles listed in Chapter Three should get reflected in the current legislation, case law and in the activities of public authorities. The request for the protection of these prav made only before the courts of common law in the manner prescribed by law.
Spain's Organic Law regulates the activities of the Institute of the Defender of the People, high commissioner appointed by the Cortes Generales and to protect their rights as provided in this Section, who may supervise the activities of public authorities and accountable Generalnym Cortez.
